                    <persName ref="http://d-nb.info/gnd/119356422">My father</persName> of blessed
                    memory has discussed the issue of the eligibility<lb/> of women for office in
                    the community’s administration in his expert opinion<lb/> printed in the monthly
                        <foreign xml:lang="he">Jeschurun</foreign>, Vol. VI <date when="1919">1919</date>,<lb/> pp. 262-266. He is of the opinion that according to<lb/>
                    religious law women must <hi rendition="#u">not</hi> be<lb/> made eligible for
                    office. </p>
                <lb/>
                <p>
                    <hi rendition="#et">He gives the following reasons:</hi>
                </p>
                <lb/>
                <p>1) <persName ref="http://d-nb.info/gnd/118576488">Maimonides</persName>
                        (H.<foreign xml:lang="he">Melachim</foreign> 1.5) decides: a woman may not
                    be appointed to the<lb/> throne, (<choice>
                        <abbr>Deut.</abbr>
                        <expan>Deuteronomium</expan>
                    </choice> 17,15) you shall set a king over you – and not a queen.<lb/> The same
                    applies to all appointments to an office (<foreign xml:lang="he">Messimoth</foreign>). </p>
                <lb/>
                <p> 2) According to 1,4 (ibid) he includes <roleName>army commanders</roleName>, a
                    leader of fifty<lb/> or a leader of ten, the <roleName>supervisor</roleName> of
                    irrigation ditches, and needless to say,<lb/> a <roleName>judge</roleName> or a
                        <foreign xml:lang="he"><roleName>Nasi</roleName></foreign>. This means it
                    applies to all sorts of military ranks, <roleName>judges</roleName>,<lb/> and
                    administrative positions.<lb/></p>
                <p> 3) In the <foreign xml:lang="he">Justratha Pesikta</foreign> on <choice>
                        <abbr>Deut.</abbr>
                        <expan>Deuteronomium</expan>
                    </choice>17,15 on the words: thou mayest<lb/> 
                    not set a stranger over thee, who
                    is not thy brother<note type="editorial" place="foot">Deut. 17,15. King James Bible</note>: thy
                    brother, not<lb/> 
                    thy sister, it follows that one must not appoint a woman as
                        <foreign xml:lang="he">Parnassah</foreign><lb/> 
                    (warden) of the community. 
                </p><lb/>
                <p> 4) It is to be understood from the <foreign xml:lang="he">Talmud
                        Yerushalmi</foreign> (<foreign xml:lang="he">Kiddush</foreign> in 4.5) that
                    the<lb/> abovementioned offices from which women are excluded according to
                        <persName ref="http://d-nb.info/gnd/118576488">Maimonides</persName><lb/>
                        (<foreign xml:lang="he">Mesimoth</foreign>) also include, for example:
                        <roleName>judges</roleName> on<lb/>financial matters (<roleName>alms
                        collectors</roleName>, <roleName>alms distributors</roleName>,
                        <roleName>law<lb/>clerks</roleName>, <roleName>executors</roleName>, (alms
                    distribution in women’s<lb/>associations understandably is an exception),
                    community<lb/>administration (<foreign xml:lang="he">Tobe Hakohol</foreign>) are
                    considered equal to the office of a judge<lb/>
                    according to <foreign xml:lang="he">Choschen Mischpat</foreign> c 37
                </p><lb/>
                <p>5) The case of the <roleName>prophetess and judge</roleName>
                    <persName ref="nognd">Deborah</persName> is to be considered<lb/>
                    an exception (<foreign xml:lang="he">TosephotSchebuoth</foreign> 29 b), and
                    similarly, the case of <lb/>
                    <roleName>Queen</roleName>
                    <persName ref="nognd">Salome Alexandra</persName> can be explained by particular
                    political<lb/>circumstances.
                </p><lb/>
                <p>
                    Eligibility of women for office means a radical break<lb/>with Jewish tradition,
                    which for this reason assigns different spheres<lb/>of influence to men and
                    women without denigrating women.<lb/>In the area of politics, this law has
                    not<lb/>brought about apparent advantages of any kind. It has not
                    helped<lb/>refine and temper manners in politics, but rather<lb/>contributed to
                    the radicalization of parliaments to the right and <lb/>the left due to a thusly
                    enlarged undiscriminating mass of voters. <lb/>The same would occur in Jewish
                    community <lb/>administrations. These already have the right to <lb/>make
                    decisions over the head of the expert <roleName>Rabbi</roleName>, even in
                    <lb/>cultural and ritual matters. This danger would be increased<lb/>by the
                    addition of numerous voters and candidates who are on average<lb/>even less
                    informed about these issues than the men.<lb/>In my opinion, even the vote for
                    women should therefore<lb/>only be supported if the <roleName>Rabbi</roleName>
                    is given the power of veto in cultural and <lb/>ritual matters. The
                    otherwise<lb/>valuable practical participation of women in matters of
                    <lb/>education and welfare can take place by inviting<lb/>them to the respective
                    committees as a consulting<lb/>voice. While no tangible advantage would arise
                    from the eligibility of <lb/>women for office from general considerations
                    either,<lb/>its introduction contrary to religious law would create a new bone
                    <lb/>of contention for the different movements within our faith,<lb/>widening
                    the schism in the community and possibly promote and reinforce<lb/>the desire
                    for a split.<lb/>Therefore it is decidedly inadvisable<lb/>for our community to
                    pursue a separate path in this matter.<lb/>Instead, it is advisable to at least
                    wait until<lb/>a <orgName ref="nognd">Prussian Community Council</orgName>
                    decides on a general direction<lb/>in this area.</p>
